VRFX Waiver
Sanitation and Safety Measures
All hardware, gears, and equipment will be sanitized and/or disinfected between each booking. Staff will follow proper hand-washing protocols between each booking.
Amusements VRFX Inc. requires that all individuals utilize approved face masks to reduce the risk of exposure for yourself and others.
It is also required that everyone wash and sanitize their hands after using the restroom.
By Signing Below:
1. Assumption of Risk
You acknowledge and fully assume all risk that, in connection with the Amusements VRFX Inc. experience, you may be exposed to, and contract COVID-19 or any other communicable disease, including as a result of actions or inactions by Amusements VRFX Inc., other participants, or third parties.
2. Health Acknowledgement
You acknowledge that:
A. You are not experiencing symptoms of COVID-19 (e.g., cough, shortness of breath, fever, chills, muscle pain, sore throat, new loss of taste or smell).
B. You do not have a suspected or diagnosed case of COVID-19 or any other communicable disease.
3. Compliance with Instructions
You agree to comply with the above written instructions and any additional verbal instructions from our staff. Failure to comply may result in your removal from the premises.
4. Release of Liability
You agree to release Amusements VRFX Inc. from any and all liability resulting from your participation in the experience, including but not limited to exposure to COVID-19 or any other communicable disease, even if arising from negligence.
5. Minor(s) Representation
If signing on behalf of a minor, you affirm that you have full authority as a parent or legal guardian to bind the minor(s) to this agreement.
6. Consideration
In consideration of being allowed to use and participate in Amusements VRFX Inc. premises, equipment, services, and activities, including but not limited to immersive VR programs (the “ACTIVITIES”), you hereby agree as follows:

7. Assumption of Risk
You acknowledge that participating in the ACTIVITIES can be dangerous and involve risks such as slipping, falling, loss of balance, dizziness, nausea, eye strain, seizures, headaches, elevated heart rate, mental condition effects, and other injuries, including unknown risks associated with VR technology.
You voluntarily assume all such risks.
8. Release of Liability
You irrevocably and unconditionally release and discharge Amusements VRFX Inc. from any and all claims related to or arising from your participation in the ACTIVITIES, including negligence.
This includes express waiver of rights under Article 1437 and Article 1440 of the Quebec Civil Code and any similar laws.
9. Property Damage/Loss
Amusements VRFX Inc. is not responsible for any personal property that is damaged, lost, or stolen while on the premises.
10. Physical Fitness Representation
You represent that you are physically fit to participate and have no medical conditions that may be adversely affected.
You have not relied on Amusements VRFX Inc. to assess your medical status or fitness.
11. Indemnification
You agree to indemnify and hold harmless Amusements VRFX Inc. from any claims, obligations, costs, losses, and legal fees arising from any claim brought against them, even if arising from negligence.
12. Photo Release
By entering the facility, you grant Amusements VRFX Inc. permission to photograph and record you for promotional purposes, waiving any right to inspect or approve the use.
13. Copyrights
You acknowledge that all results and proceeds of your participation are owned by Amusements VRFX Inc., including any copyrighted works created as part of your participation.
14. Electronic Signature Consent
You consent to the use of an electronic signature in place of a handwritten one. You acknowledge your right to request a paper signature instead and understand there is no fee to obtain a paper copy.
Final Acknowledgment
By signing this document, you understand that you may be permanently waiving your rights to bring legal action against Amusements VRFX Inc.
You confirm that you have had sufficient opportunity to read, understand, and consult legal counsel regarding this document.
By signing below, you agree that all releases, waivers, and promises herein are binding on the minor(s) listed below, and affirm that you have the authority to bind them to this agreement.
